Doing Law Differently
Great Work + Great Culture = A Great Australian law firm. David Newman, on how Maddocks is combining clients and culture to continue to grow (ep 98)

If you ask a law firm leader to list their firm’s top values, there’s a good chance you’ll hear words like “access to justice”, “innovation”, “excellence” and “integrity”. For Maddocks, though, the guiding value is something far more unique: “stewardship”.

As David Newman, partner and CEO at Maddocks, explains to me in this interview, stewardship is about embracing the concept of leaving the firm in a better place for the next generation of leaders and is just one of the reasons that the team at Maddocks have created a Great Australian Law Firm.

In the last interview for 2021, David and I talk about innovation, staff retention, flexible working and exactly what makes Maddock’s what David calls a Great Australian Law Firm.

This episode is brought to you by The Prepared Company.

About David Newman

David is a partner and the CEO of Maddocks. He joined Maddocks and its Restructuring & Insolvency team in 2000 and was appointed a partner in 2002. Prior to being appointed as CEO in October 2020, he held numerous leadership positions at Maddocks, including Practice Group Head of the firm’s Corporate & Commercial practice and Practice Team Leader of the Banking & Insolvency practice. Away from work he have four children and enjoys cooking, fishing and diving.

Maddocks is a leading commercial law firm ranking in the top 15 law firms in Australia by partner size. They like to think of themselves as a Great Australian Law Firm, with a business covering all areas of commercial law.

David Newman quotes

* “I think one great test of retention for us is the boomerangs we have, the number of people we have that leave and whether they go overseas for a while, or whether they go in-house or some have even gone to our competitors or peers and they come back because they go ‘the grass isn’t always greener and we liked it where we were.’”

* “[Stewardship] is a guiding principle … it also becomes a responsibility and an onus on partners…it becomes an obligation to actually put into action, to actually bring the next generation through to grow the practice so that people can share in the firm, rather than focus simply on what you’re doing on the day to day and focussing on your career.”

* “As good as Zoom is and Teams is it really takes away from the experience… the top 10 experiences I’ve had, none of them have been online. Being able to move away from the theoretical to the practical for these younger lawyers is a real challenge for firms and hopefully they’ll stick it out and have those experiences and be the partners of the future.”

* “The challenge is to pick what makes it better rather than just because we can. Just because we can have this conversation via Zoom, doesn’t mean we should. There are interactions that should be had in person and there are tasks that should be done in person. There’s learning, there’s mentoring there’s a lot of collaboration that sure it can be done on a screen, but it can’t be done as well.”

Hire for now: perfect-fit contract lawyers for short-term needs with Fionn Bowd (ep 97)

Fionn’s idea was simple – to have the flexibility to do the work she loved doing and to do it the way she thought it could be done. But with a background working in with big firms and big companies with traditional values, Fionn found she was not given the opportunity to explore her ideas.

Fionn decided there had to be a better way for lawyers to work and came up with an idea – ‘what if lawyers could sell their time back to law firms?’

Enter: Fionn’s firm, Bowd, a law firm for law firms with a focus on perfect-fit contract lawyers. She believes that when you need a particular skillset for a particular piece of work, just hire that skillset – you don’t always need to hire for the long term.

Listen in to learn more about Bowd and Fionn’s views on the progressive law movement.

This episode is brought to you by The Prepared Company.

About Fionn Bowd

Fionn is a former big projects and infrastructure lawyer turned legal services entrepreneur. After a career with big firms and big companies, Fionn decided there had to be a better way for lawyers to work. She wants lawyers from all backgrounds to continue to work in law firms, as a diverse profession serves society best.

Fionn’s firm, Bowd, is a law firm for law firms, with a focus on perfect-fit contract lawyers to smooth the workload in law firms and prevent burnout and attrition. They provide a well-paying and rewarding career option for lawyers who love complex legal work but can’t see themselves inside law firms for the long haul. Bowd also provide other specialist services to law firms, like tender preparation, research and article writing.

Fionn Bowd quotes

* “The firm has no costs, they get to charge this person out and then pay them an hourly rate. The firm takes its profit on the charge out rate and it works really well. Lawyers get double market salary, the firm gets half its charge out rate, we get a cut and everyone goes home very, very happy.”

* “When you need a particular skill set for a particular piece of work, just hire that – don’t add people to your team who are going to be a bad cultural fit, who cause conflict, who are going to fade into the background or aren’t going to help because they don’t have the technical skills, no just hire the technical skills.”

* “We’re all just humans living human lives, we all have our own challenges and for some people that’s kids, for some that’s parents for some people it’s needing to not work a full workload because their mental health is not supporting it… there’s so many reasons.”

* “I think that’s what we need to do, I think we need to break the structures of our firms up into what we need for the short term and what we need for the long term. And potentially a medium term as well.”

Find Fionn online at Bowd website and LinkedIn or join Fight Club for Lawyers on the Clubhouse app.

Proving the critics wrong – Growing a specialist law firm in a country town with Bernadette Duell, Great Southern Wills (ep 96)

After 20 years’ experience in estate law, Bernadette Duell saw her fair share of inadequately drafted Wills and thought, ‘there must be a better way.’

After moving to Albany in the south of Western Australia, Bernadette saw her opportunity to fix the problems she’d encountered at their root cause. She decided to establish a law firm that specialised solely in Wills and was met with a lot of criticism from her peers who told her that a specialist law firm wouldn’t succeed in a country town. She persevered, launched her firm Great Southern Wills in April 2020 and has proved the critics wrong, with a 200% growth in 18 months.

Launching during the Covid lockdown, Bernadette found Facebook a relevant platform and introduced her ‘mythbuster’ videos, providing short informational videos about the common myths associated with Wills.

From there, word of mouth in the community has played a big part in her success, as well as the ways in which she does law differently, such as free consults and fixed price products.

This episode is brought to you by The Prepared Company.

About our guest

Bernadette grew up in Sydney, gained her Masters at Sydney University and spent the first 10 years of her career in Sydney at top tier and medium tier law firms. She developed a specialty in tax, structures and estate planning, acting for high-net worth individuals.

Bernadette moved to Albany, Western Australia, far from the city life she was accustomed to.  She launched her firm, Great Southern Wills, during Covid lockdown 2020. With everyone at home, she posted video mythbusters on Facebook, which generated much discussion in the community. From there word of mouth in a small regional town has generated clients with the firm growing 200% in 18 months.

Bernadette Duell quotes

* “I thought there must be a better way of practising law rather than dealing with the fallout, the disputes, there must be a better way…and I thought why don’t these people get a proper will done in the first place, an up to date, properly advised Will. These people need a specialist not your country lawyer doing all types of law.”

* “The lawyers in the country town, they’re hourly rates…and it’s like tick-tock, tick-tock. For me it’s like sitting in a cab at a red light and the meter’s tick, tick, tick, but you’re not actually providing a service when you’re at a red light, so what we provide is fixed fees.”

* “It feels so good just to hear a client say you’ve given them the peace of mind, and I’ve now provided for my family. It’s the greatest gift to know that if they were to pass away or become incapacitated everything will be taken care of.”

Find Bernadette online at Great Southern Wills, Facebook and Instagram.

Doing Law Differently
Building a Homeforce in law and beyond with Jo Alilovic, 3D HR Legal (ep 95)

After many years spent working at a traditional law firm, Jo established 3D HR Legal, a specialist employment law firm that operates in a completely virtual working environment.

Jo quickly realised that the concept of being family friendly and flexible was a point of difference and the firm grew rapidly.  When COVID hit in 2020, Jo realised that her unique experience of managing her own remote team combined with her employment law expertise put her in the perfect position to support other businesses through the transition to remote work. Now it’s time to embrace flexible and remote work arrangements for the long term, Jo has written a book, Homeforce to help employers build a connected, engaged home-based team.

In this episode, Jo and I talk about the benefits of working remotely, but also about boundaries, being able to “switch off” and keep home and work life separate when there is no physical office. Jo also introduces us to her 6-step ‘REMOTE’ framework to build a thriving, distributed team who work from home (at least some of the time).

This episode is brought to you by The Prepared Company.

About Jo Alilovic

Jo Alilovic is the Director and founder of 3D HR Legal, an employment lawyer with 20 years’ experience, author and flexible work advocate who leads by example.

Jo was an early adopter of the remote first and hybrid workforce, managing her own fully distributed team for the last five years. After over a decade working for the largest law firm in Western Australia, Jo’s own business started as a bit of an accident – as so many good things do – when she decided to move down to Donnybrook with her family. At the time working remotely wasn’t the done thing. She quickly saw the opportunity to build a new style of law firm, one which would not only allow for location freedom and flexible work hours, but would also enable her to live out her dream to have both a successful career and a fulfilling family life.

3D HR Legal is a specialist employment who work with professional services businesses to help them avoid legal claims, learn what they don’t know, and create thriving workplace cultures that help business prosper.

Jo Alilovic quotes

* “I felt that I had flexibility because they knew me and because I had been there so for long. The difference with the business that I run is that you’ve got the flexibility from the moment you walk in the door. It’s starting from a point of trust, there’s no need to earn the right to it, it is a right that you have.”

* “I like to encourage people to think of it like you are in an office, I worked in an office with four floors, we would always just pick up the phone and call someone, we wouldn’t worry about always walking up and down the stairs…that concept is the same no matter where you go people have this block that just because you aren’t in the vicinity of each other you can’t do it.”

* “[A Homeforce] is working so well for me I just wanted to be able to help other people create the same thing in a way that worked, that’s why it very much became a how-to book. If you’re going to create a remote or hybrid team then you need a plan.”

Oh, Christmas Tree! Embracing creativity in law with Anthony Curtin, Merton Lawyers (ep 94)

Anthony Curtin credits Christmas trees, in part, with being a better lawyer. Intrigued?

Back in 2009 Anthony found himself stung by the GFC and losing his job to redundancy. Needing to draw an income between jobs, he started a Christmas tree delivery business, Melbourne Christmas Trees, which is still successful today.

Anthony found that his business had a much bigger impact than he ever expected. More than just delivering trees, Melbourne Christmas Trees helped children to create happy memories and taught Anthony that business could be a vehicle not just to make money, but to contribute to a greater good.

Fast forward to 2016 and Anthony and his friend Dave Rennex started collaborating about their next venture. They discovered they both enjoyed law and shared the same values. They started Merton Lawyers under a stairwell in a co-workspace and the business rapidly grew to take over the entre venue.

Working with founders, tech companies and the people that like to invest in those companies, they bring the values and creativity from Melbourne Christmas Trees to the legal field, even employing staff from Christmas Trees and creating opportunities for their staff and clients.

This episode is brought to you by The Prepared Company.

About Anthony Curtin

Anthony is a lawyer, founder and family guy. He loves working with founders, tech companies and those that invest in them but also spending time with his family and being forever challenged and inspired by his three kids.

In 2016 Anthony started Merton Lawyers with Dave Rennex. They now employ 23 people across four locations in Victoria and Queensland. They advise clients in corporate/commercial law, dispute Resolution and property construction.

Find Anthony online at Merton Lawyers, on Instagram and LinkedIn.

Anthony Curtin quotes

* “It’s incredible to see the journey that a lot of our clients have gone from back in 2006 to now and they’re now, by progression or growth, it’s natural for them to look to the US and we kind of want to go on the journey with them.”

* “It’s not just the tree that we are giving, it’s the smell of the tree, it’s actually developing happy memories for a lot of these kids that have gone through a really challenging time. That is one of the most fulfilling parts of my work across anything that I’ve done.”

* “We’ve got three of our staff at the moment… that have worked across account management, business development, management of clients…so for them at a junior level they’re getting exposure to a start-up, they’re getting practical experience, and it just adds another feather to their bow.”

Targeting the “missing middle”: Prevention is better than cure with Jacqui Brauman, TBA Law (ep 93)

Jacqui Brauman has spent time delving into the psychology of the ‘missing middle’ and understanding the barriers that prevent upwards of 80% of people from getting professional advice.

With the goal of creating a safe space for women to access legal services, Jacqui started Legally Wise Women, which she describes as an information and education hub, a community and a starting point for women who need advice. Reflecting on other businesses that have progressed or even been disrupted by automation and technology, Jacqui aims to keep the humanity in being a lawyer. She says it’s only a matter of time before something big happens in the legal industry and aims to be ahead of the game as much as possible with her law firm, TBA Law.

This episode is brought to you by The Prepared Company.

About Jacqui Brauman

As well as being the CEO of Legally Wise Women, Jacqui Brauman created her firm TBA Law in 2012, providing estate planning, family and property legal services to families in Melbourne and Regional Victoria. Jacqui is an accredited specialist in Wills and estates, and an award-winning lawyer. She is an NMAS mediator, a collaboratively trained dispute resolution practitioner and she has written and published four books.

Find out more at TBA Law.

Jacqui Brauman quotes

* “We’ve done a whole lot of work about our values so in our tagline we now say it [TBA Legal] stands for the better approach and we also say it stands for to be accountable, to be approachable and a couple of our other values…we’ve used the play on words a lot.”

* “I’ve thought a long time about how to create a safe place for women to land and get pointed in the right direction and learn a little bit about the legal industry so when they are actually going to hire someone they know what to look for and they don’t get taken down a path they don’t need to go on or just to show them a whole heap of alternatives…I don’t think Google is the best place to start.”

OpenLegal: Removing barriers through fixed price subscription services (ep 92)

After leaving a litigation role in London and feeling a bit disconnected from the world, Philip Evangelou signed up to a Nomad MBA, where he spent three months studying digital marketing in South Africa. Fast forward to 2020, and he then found himself at the end of an employment contract and at the beginning of a COVID lockdown. While many of us would panic, Phil saw this as an opportunity to launch his new firm OpenLegal.

Phil credits his success in part to those newly found digital marketing skills as well as to his experience with founding two other start-up businesses.  Those experiences, he says, have helped him to successfully create a platform to not only build a client base but to also nurture those clients and build lasting relationships.

We talk about:

* some of the more modern processes OpenLegal have adopted, such as their fixed-price subscription-based service which aims to remove the traditional barriers of accessing legal services;

* the benefits of building customised law practice software; and

* what the future holds for this type of new law.

This episode is brought to you by The Prepared Company.

About Philip Evangelou

Philip is a qualified lawyer with over 14 years’ experience. Philip has worked in both private practice and as an in-house counsel in Sydney and London at various law firms, national insurers and fast growing multinational companies.

Using his legal expertise and experience of starting multiple businesses, Philip aims to help other entrepreneurs start, scale and grow their businesses by solving all their legal problems and helping to mitigate or manage risks that arise in various industries.

Philip is also a philanthropist and Founder of a social enterprise called Kupendo Kids which employs women in Cape Town and supports orphanages in third world countries.

Find out more at Open Legal, LinkedIn and Kupendo Kids.

Philip Evangelou quotes

* “It’s been a journey in terms of learning on the job, this is the first business I’ve had where I’ve employed full-time staff, so it’s not just about the marketing but people management, building cultures, managing cash-flows and finance… It’s probably the best way to learn how to run a business rather than doing an MBA. Just dive in and do it.”

* “I felt a bit disconnected from the world, I really felt like I wanted to go overseas and do some good so I signed up for a program called Nomad MBA. I travelled to Southern Africa for 3 months with 30 other international student and we studied a particular new skill… my skill I learnt was digital marketing”

* “I found this toy making shop in Cape Town which is run by indigenous women… I took them my logo of Kupendo Kids, which is the name of my social enterprise and said I want to create children’s’ toys so they created a prototype for me and I thought I’m going to use my digital marketing skills to launch this and for every toy we sell we donate one to an orphanage in South Africa”

What if it doesn’t look like a law firm? Taking inspiration from clients, not lawyers (ep 91)

The covid pandemic forced the world into a whole new way of thinking and for Alistair and Shona, it marked the creation of their innovative new law firm, Tend Legal.

Having the opportunity to design their firm their own way, Alistair and Shona took inspiration from creative agencies and tech companies and asked, ‘Why can’t we do that with a law firm?’.

Focusing on communication, customer service and lasting client relationships, Tend Legal talk about how dealing with a law firm can be a positive experience and how the work they do leaves them feeling excited about their clients;’ hopes and dreams.

With Alistair leaving a partnership role after 13 years and Shona returning to the workforce after ten years as a stay-at-home mother, things are surely different than they’re used to, but they manage to make it work.

This episode is brought to you by The Prepared Company.

About Tend Legal

Alistair is a commercial solicitor with a wide practice encompassing commercial, company, employment and dispute resolution. He was partner of a firm in South London for 13 years, until he left in December 2020 to start Tend Legal with his wife Shona.

Shona is a qualified solicitor, but had taken a break from practising while their children were young. At Tend, Shona is responsible for managing the accounts, marketing and general operations of the business.

Alistair & Shona live in Epsom in Surrey and have 3 children aged 11, 9 and 4.

Alistair Wells quotes

* “There was a time in law when wearing a suit made perfect sense because all of your clients were businessmen, so to communicate with them that’s what you do. It’s no different it’s just that the world is changing…we have to communicate in a much more human way and much less formal way…that’s what people expect.”

* “Coming out of lock down, the Zoom call where you saw people’s families and pets and every call would start with ‘How are you doing, … is everyone alright? That kind of human connection is really good… seeing people for who they are is really important.”

What are we fighting for? Out of court solutions for separating couples with Kirsty Salvestro, Flourish Family Law (ep 90)

Kirsty’s biggest rule is ‘No court’.   After her own bad experiences and seeing her clients struggle mentally and emotionally with the court process, Kirsty has developed her business to focus on out of court solutions.

Kirsty took a big step in leaving the traditional law firm where she was partner for seven years to concentrate on helping people in her own authentic way. Through mediation, coaching and collaborative practice, Kirsty lives by a kinder, calmer approach to family law to help separating couples reach peaceful negotiations.

To further prepare clients for the negotiation process, Kirsty has developed an online training course and has written a book, ‘What are we fighting for? A Peaceful Pathway for Separating Couples’ which she readily shares with her clients.

Join me in my conversation with Kirsty to learn more about how Flourish Family Law are doing law differently.

This episode is brought to you by The Prepared Company.

About Kirsty

Kirsty describes herself as a Family Lawyer, Mediator, Divorce Coach, Author and founder of Flourish Family Law, a Boutique Law Firm that specialises in helping families separate peacefully and out of court.

Kirsty left her rural regional practice 4 years ago to start her own boutique law firm. Today, Kirsty’s work is solely focused on helping separated couples reach amicable agreements by providing solutions that focus on kind and peaceful negotiation methods.

Kirsty’s mission is to help as many families as possible learn about and be educated on peaceful separation solutions so that they can become stronger during and thrive after separation.

Kirsty Salvestro quotes

* “I find that the coaching keeps them in the calmer, controlled and supported state, rather than really emotional, expressing themselves in anger because they’re hurt and confused. Having the coaching, you’re able to pull them back in and reality test without them going off the path. Coaching clients tend to stay really well focused and move onto some really great family law solutions.”

* “I really focus on kindness, I believe kindness and following your behaviour and values is so important… but also preparing the person, not just the papers and documents but really getting people to think about everything before they start moving on to negotiations.”

More than just a motto: Building long term client relationships with Stipe Vuleta, Chamberlains Law Firm (ep 89)

The Doing Law Differently Podcast is back with the last season of 2021. Today, I’m joined by Stipe Vuleta, Managing Director at Chamberlains Law Firm.

Back in episode 82, James d’Apice gave us a glimpse into life at Chamberlains and suggested I speak with Stipe to learn more about some of the law firm’s innovations. In this episode, I do just that.

Coming from a sense of family and self-actualisation, Stipe reflects on his interpretation of what makes a good lawyer and what makes him excited to be in the industry. He shares his insights on the culture at Chamberlain’s and how their motto ‘We’re with you’ is more than just a motto, it’s about changing people’s lives.

We talk about building long term client relationships, how to build a positive workplace culture, reducing communication barriers and how the average client life cycle is not one size fits all.

Stipe also tells us about wills online, Chamberlains’ innovative Wills product which not only streamlines Will making, but creates opportunities for corporate social responsibility.

This episode is brought to you by The Prepared Company.

About Stipe Vuleta

Like most – or probably all – of us, Stipe is many things to many people. He describes himself as Managing Director. Restructuring Lawyer. Coffee Addict. Music Lover.

Chamberlains is a dynamic full-service law firm, assisting clients across the nation. The firm has a long and proud history, spanning over half a century of well documented growth through excellence. Chamberlains values constant innovation and the adaptation of modern legal practices and continue to invest heavily in technology and systems to provide better client outcomes and a more enjoyable experience for their team.

Connect with Stipe at Chamberlains, on Instagram, LinkedIn and YouTube.

Stipe quotes

* “We are genuinely a family and we spend a lot of time thinking about our relationships, our stakeholders, the way we bring people into our fold and the way we can try to improve peoples’ lives. That’s why we say ‘Were with you’ is more than a motto, it’s a way of life for us.”

* “The outcome is whether the clients are being looked after, whether we’re front of mind, whether we’re giving them the security and whether we’re able to invoke a sense of trust.”

* “Chamberlain’s is not out there looking for the client who wants value above all…we’re actually looking for a values-based purchase we’re looking for a client that shares our values, for us that’s long term relationships, passion and creativity.”

Doing Law Differently
The five stages of law firm development (ep 88)

After spending the last two months working closely with a handful of law firm leaders in my Productise and Profit Program, I’ve been thinking a lot about the journey to creating a progressive law firm. In today’s episode, I want to talk about that journey. And, yes, it is a journey.  Transforming the way your business operates doesn’t happen overnight. The journey involves changes in attitudes, values, mindsets, ways of thinking and ways of working, but it will lead you to an entirely new way of business and a new lifestyle.

In this episode, I talk you through the five stages of law firm development – from traditional law to having a thriving product ecosystem. We look at:

* Traditional law* Limited scope* Specialist law firm * Productised services* Product ecosystem

Doing Law Differently
Law firm welfare – assessing the impact of COVID-19 with Simon Tupman (ep 87)

The COVID-19 pandemic has radically changed the way people live and work, and law firms are no exception to that rule. Many of us have seen increased working from home arrangements, more flexibility, better use of technology and a more sustainable work-life balance, while others have experienced a negative impact on morale, health and well-being and team culture.

Simon Tupman is a business speaker and mentor to professionals and professional service firms. He works with law firms from all around the globe and has recently carried out research to assess the impact of COVID-19 on law firms generally.

In this episode, Simon and I talk through his findings, looking at what has changed, for better or for worse, whether the changes are permanent or temporary, and what changes firms plan to make to their operations as a result of the events of the past 12 months. If you’d like to read Simon’s report, you can download the complete report here.

As always, I finish the interview by asking Simon for the advice he would give to someone who wants to do law differently. He shares some really insightful comments about leadership – why leadership in the legal industry is underdeveloped and more importantly, what we should do about it.

Thank you once again to Legally Yours and LawCPD for sponsoring this episode and making it possible for me to keep bringing these episodes to you.

About Simon Tupman

The progressive law movement: Reinventing the delivery of legal services with Karen Finch (ep 86)

Karen Finch is the CEO of Legally Yours, an Australian legal marketplace that enables everyday Australians to access quality, experienced lawyers without the bill shock. She is also a passionate ambassador of the progressive law movement and a very wise one at that.

In this interview, not only do we dive deep and learn the ins and outs of how Legally Yours operates, but we also get the benefit of Karen’s generous wisdom about what it really takes to create a successful progressive law firm.

The standout for me is the clarity with which Karen was able to distill consumer needs into three simple points. Karen identifies the need for price transparency; access to information; and trusted guidance when choosing a lawyer (after all, so many law firm websites look the same!) as the three main barriers that prevent consumers from accessing legal advice. There is so much wisdom in that conversation that takes many (myself included!) decades to learn.

We talk about why lawyers shouldn’t charge for their services based on time, the importance of customer centricity and how to discover your passion and turn it into a business.

Thank you once again to Legally Yours and LawCPD for sponsoring this episode and making it possible for me to keep bringing these episodes to you.

About Karen Finch

Karen is a non-practicing lawyer, CEO of Legally Yours, Vice President of the Australian Legal Tech Association (ALTA), Legal Tech Editor for Idea Spies, Law Reference Advisory Member at CQ University Law School, a Lead Organiser for the Silicon Beach Australia startup community, a passionate ambassador of the progressive law movement, and a strong supporter of the Australian startup ecosystem.

Legally Yours is an Australian legal marketplace that enables everyday Australians to access quality, experienced lawyers without the bill shock. They take away all the confusion and difficulty in trying to find a lawyer, by matching clients with vetted, experienced lawyers who only offer upfront fixed pricing on their legal services.

They also support and empower lawyers who are delivering legal services differently by providing them with a community of like-minded lawyers around Australia that they can connect with and refer business to, education and networking events.

High tech, no tech, and everything in between – why it matters for in house lawyers with Mel Scott (ep 85)

I’m joined by fellow podcaster, Mel Scott. Mel is the host of Counsel, a podcast about in house lawyer life that she launched during covid lockdown. Mel has worked in house across multiple industries and is a passionate advocate for what I call “doing law differently in house”. For Mel, this includes shining the light on in house lawyering as a legitimate career alternative to the single narrative we’re led to believe at uni.

Today, Mel is the Senior Counsel at Megaport Limited, a global technology company founded in Australia, that ‘does computer networking differently’.  In this episode, Mel gives us a glimpse into in house life at Megaport. As you’d rightly expect from a global tech company, part of their “doing law differently” story is about technology, but it is about *so* much more than tech.

I also talk to Mel about her podcast, Counsel, including why she started it and what she’s learned from it and Mel leaves us with some valuable advice that every lawyer needs to be reminded of from time to time – “progress is better than perfection!”

Thank you once again to Legally Yours and LawCPD for sponsoring this episode and making it possible for me to keep bringing these episodes to you.

About Mel Scott

Mel has worked in house across multiple industries and is now a passionate advocate for all things in house.  She launched “Counsel”, a bootstrapped podcast about in house lawyer life, during COVID-19 lockdown and is passionate about sharing career insights about in house life for law students and graduates.

Mel is the Senior Counsel at Megaport Limited, a global technology company founded in Australia, listed on the Australian Stock Exchange in 2015 and now is in the ASX200 (ASX:MP1). Megaport is a disruptor in its industry that ‘does computer networking differently’.

Stepping out from behind the title: leading through authenticity and vulnerability with Niti Nadarajah (ep 84)

Today I’m joined by Niti Nadarajah, a senior in-house lawyer working in Melbourne. But more than being a lawyer, Niti is also a woman, a mother and a human being.

Niti has become an advocate for authenticity and vulnerability, mental health issues and DEI at her workplace and online and it is this aspect of Niti’s many superpowers that I focus on in this interview.

Yes, doing law differently is about new business models, pricing, customer centricity and so many more things we often talk about, but it is just as much about authentic leadership, stepping out from behind the title and showing our authentic, human selves.

As we hear from Niti, when we do that – the benefits continue to flow not just to ourselves but also to our leadership, teams and businesses too.

Thank you once again to Legally Yours and LawCPD for sponsoring this episode and making it possible for me to keep bringing these episodes to you.

Trigger warning: Niti and I discuss pregnancy loss in this episode.

About Niti Nadarajah

Niti is a senior in-house lawyer working in Melbourne. But more than being a lawyer, Niti is also a woman, a mother and a human being.  As she has grown into her career and life has thrown challenges at her, including the juggle of motherhood, Niti has become an advocate for authenticity and vulnerability, mental health issues and DEI at her workplace, on LinkedIn and more broadly. She is passionate about leadership that demonstrates empathy and courage, kindness and vulnerability and about helping others find their courageous wonderful selves in what can at times be a precarious world.

How to build a practice you and your clients will love with Joshua Baron (ep 83)

Joshua Baron is an Attorney at SB Legal, a criminal defense practice, based in Utah.

I connected with Josh on LinkedIn a few months ago and two things instantly stood out about him. First, his friendliness and genuine interest in the people he connects with (try it for yourself and see!), and second, how upfront and honest he is about his own experience building a law practice – from starting with very little experience, competing on price and working for next to nothing, to building a practice that he and his clients love and charging premium prices for the privilege!

Like many of the people I speak with on the podcast, Josh is definitely not afraid to share where he has gone wrong in the past and the lessons he’s learnt along the way. Listen in to learn about Josh’s experience with building a criminal law practice that both he and his clients love.

Thank you once again to Legally Yours and LawCPD for sponsoring this episode and making it possible for me to keep bringing these episodes to you.

About Josh Baron

Josh Baron is a criminal defense attorney at SB Legal based in Utah. He started his criminal defense practice in 2009 after leaving a job as a city prosecutor and since then has gone on to build a business that both he and his clients love.  Josh is proactive in sharing the lessons he’s learned from building his practice, including by publishing his book, The Business of Criminal Law: How to build a practice you and your clients will love. He loves building referral relationships for SB Legal business and consulting for other attorneys to do the same.

Josh and his wife have 12 children, so of course that gets a mention in the episode too!

Find out more about Josh at SB Legal, connect with him on LinkedIn or get a copy of his book on Amazon.

Quotes from Josh Baron

* “There’s not a cookie cutter / everybody should follow these steps, but I hope that my firm reflects my personality, my values and my interests. We need more weird law firms that reflect the practitioners values. We don’t need more identical firms, we need firms that are weird.”* “There’s a place for all kinds of weirdness, especially in this solo, small firm practice where you can lean in to what makes you unique and attract customers and clients that are looking for that. And maybe they don’t know that they’re looking for it, they just haven’t liked what they’ve gotten from every other legal experience that they’ve had.”* “I shouldn’t just try to achieve a generic best outcome, I should try to figure out what this client needs and then make an outcome for them.”* “Instead of having a preconceived idea of exactly what the fee is gonna be, what the strategy’s gonna be, all that trying to fit the client into this container that I have in my mind, going into the conversation with the client and being really open and present and listening and trying to figure out what’s best for this client, helps a lot in creating the connection that leads to wanting to work together.”

Coffee and a Coach Note with James d’Apice (ep 82)

In today’s interview, I’m joined by James d’Apice who you may know better as “the guy who does Coffee and A Case Note”. James’ simple but unique way of marketing his practice is to record short case summaries from his local café while he enjoys a nice cup of coffee.  Then he uploads them to social media to share his expertise with the world.  While it may have started as a bit of fun, CACN is now a source of new business for James at Chamberlains Law Firm.

In this episode, James shares how Coffee and a Case Note has evolved over the years, how it generates new business and some advice for us all to embrace social media in our own businesses.

There’s a lot to love in this episode, but the stand out for me is James’ advice about letting the lawyer mask slip and showing the human underneath. That, and his clear message to “just get on with it” when it comes to video and embracing social media. After all, we’re no longer in the business of selling information, but instead, we’re selling access.

This episode is brought to you by Legally Yours and LawCPD.

About James d’Apice

James is a corporate and commercial litigator practising in Sydney. He uses the internet to promote his practice via a project known as “Coffee and a Case Note”.

James is a Special Counsel at Chamberlains Law Firm. Chamberlains are a full service firm with profound expertise in insolvency and property. At heart they are a Canberran firm but have rapidly grown over the past few years, and continue to. They now have over 100 employees and are in: Perth, Canberra, Newcastle, Sydney.

To connect with James, please search “Coffee and a Case Note” or the hashtag #coffeeandacasenote on your preferred platform. You can find him on LinkedIn, Clubhouse (and just about every other social media platform!) and find out more about Chamberlains Law Firm here.

Quotes from James d’Apice

* “If case notes are good and videos are good, what happens if I combine the two?”* “When you’re publishing stuff in the market you think not about “me, me, me”, but about “you, you, you”. I’m trying to bring as much value as I can.”* “Every time you see my face I am putting on the line my reputation as someone who is good at explaining this.”* “My biggest piece of advice for trying to push people off the ledge is to get them to choose their favourite medium. What are they looking at while they’re waiting for coffee or waiting for the bus? If they’re Instagram people or twitter people or TikTok people, just go with that.”* “You have things in your head which are valuable and by keeping them to yourself, that is completely fine, what you are charging for in your business then, is information … but we are no longer really in the business of selling information … me and you and people like us are in the business of sharing information and giving information freely and as willingly as we can, and what you and I sell is access.”* “To be an innovative firm is to be an open-minded firm.”

Doing Law Differently
Reducing the unnecessary suffering in conflict resolution with Lisanne Iriks, Life Mediation (ep 81)

Many of the people I speak with on the Doing Law Differently Podcast are on a mission to #makelawbetter. They’ve experienced the legal system up close and personal and they want to improve it, whether through improving access to justice, providing alternative pathways to resolve disputes or simply by being providing a better customer or staff experience.

Lisanne Iriks is no different. Lisanne is a conflict resolution specialist and mediator who believes that there’s a lot of unnecessary suffering when it comes to conflict resolution and her mission is to reduce that.  She does that through her work as a mediator in family law and workplace mediation and also through her training programs, where she trains people in conflict resolution, negotiation and communication skills.

I chose to focus the interview with Lisanne in two areas. First we get an understanding of the role mediation has to play for clients. Second, we move into a conversation about the skills we need as lawyers to help resolve conflict.

What I really took away from this interview was the recurring theme that I am reminded of all the time: that we need to focus on deeply understanding our clients. We need to truly understand who they are and what their challenges are. Not just the surface level ones, but the ones that keep them awake at night. Only when we do that can we properly start to help them resolve their conflict.

This episode is brought to you by Legally Yours and LawCPD.

About our guest

Lisanne Iriks is an award-winning mediator who specialises in family mediation and workplace mediation.

Life Medition are mediation specialists in Perth, Western Australia offering Family and WorkPlace Mediation as well as online and face to face conflict resolution training and workshops.

Find out more at Life Mediation website, Instagram or LinkedIn.

Lisanne Iriks quotes

*  “Conflict is great … when change occurs it’s normally conflict that starts it off … conflict requires innovation, communication, problem solving and … when you are able to work through a conflict with someone … the relationship actually improves a lot.”* “If you’re a lawyer, just pick up the phone and call the other party …”* “As a lawyer you need to get really good at finding out those underlying issues so you don’t get surprised at mediation because you know about it … The best lawyers I work with in mediation go and ask the other side “what’s really important to you? Tell me about that.””* “As a lawyer you can create so much value for your client here – people just want to be heard. They want to have a seat at the table.”  * “Just listen to people. Human beings are problem solvers and, lawyers in particular, because that’s what you get hired to do. Sometimes you need to let people just finish without solving any problems. First of all, they feel heard. If you stop them and constantly try to resolve the problem you don’t get the full story.”

Doing Law Differently
An evolved approach to BigLaw – with values, culture, innovation and collaboration at the core with Nick Humphrey, Hamilton Locke (ep 80)

If you have any interest in business leadership or deliberately designing workplace culture, you won’t want to miss this episode!

Nick Humphrey is the Managing Partner of Hamilton Locke, a corporate and commercial law firm that is one of Australia’s fastest growing law firms. They focus on aligning the interests of their people with their clients. What does this mean? Well, as you’ll hear in the interview, Hamilton Locke is a people-centric business where the number one priority is to create a vibrant culture.

As Nick explains in the interview, he strives to create a work environment focused on learning, teamwork and collaboration because having a strong people experience drives the best possible client experience.

I love Nick’s approach to people, culture and leadership and really admire the example he is setting for our industry. Nick and I talk about a lot of my favourite topics –

* how to build a deliberate high performing culture,* how to identify a business purpose – and I especially love Nick’s approach to considering the impact a business will have on different stakeholders* process improvement and reducing the grunt work to free up people’s time for more enjoyable and meaningful work.

This episode is brought to you by Legally Yours and LawCPD.

About our guest

Nick has a distinguished 25-year commercial legal career, advising on hundreds of high-profile transactions, as well as founding Hamilton Locke. After 10 years in senior management and leadership roles, Nick recognised an opportunity to start with a blank piece of paper and build a firm as an evolution of the legal industry. He identified the importance in leadership of mindfulness and positivity, building culture, driving innovation and implementing a value-based model, leading to the ultimate optimisation of the client experience.

As one of Australia’s top 50 and fastest growing law firms, Hamilton Locke transforms the traditional approach to corporate legal services, removing bureaucracy and administration, focusing on solving complex client problems. They have built a people-centric business from day one, bringing together top talent from across the globe. They are driven by maximising the ‘people experience’ – PX and creating a vibrant culture. They believe a strong PX drives the best possible ‘client experience’ – CX and therefore strive to create a work environment focused on learning, teamwork and collaboration, underpinned by a values-based leadership model.

Visit Hamilton Locke’s website here.

Nick Humphrey quotes

* “be very deliberate about the culture that you want to have in your firm and make sure that the values are clearly held by everyone. If you don’t do that, what you end up with is either a neutral culture or a culture that is toxic and makes it an unpleasant place to work. What we do is consider can you combine a clear purpose, a set of values, deliberate culture, non-negotiable behaviours and bring all those things together … when it comes together you can create something which supports your purpose?”* “A lot of firms have a set of values which might be a poster on the fridge … but those values aren’t unique to that business, they’re not authentically held by all the partners and staff because they didn’t discover it, they just got told it.”* “If you just get up and speak to everyone and say “hey, these are our values” it will go in one ear and out the other ear.

Doing Law Differently
The six-step blueprint to reshape your firm and regain your life (ep 79)

Most of the lawyers I speak to tell me that all they really want is to be able to take a holiday. A short break away from the office to refresh and recharge and find some of that freedom they were chasing when they started their business.

Instead, they find themselves stuck in the trenches: settling documents, writing cheques, supervising staff, answering phones and tied to their inbox. If they take their foot off the pedal, the whole business slows down.

They’re too busy doing client work so they can pay the bills and can’t seem to find the time to work on their business

Aside from the day-to-day challenges, the biggest struggle law firm owners describe to me is that they know they need to do something differently, but they don’t know what to do and in what order.

After over a decade leading law firm transformation, I’ve created a six-step blueprint to take law firms from traditional law to a thriving product ecosystem. It’s called Productise and Profit and I wrote about it in my book, It’s Time to Do Law Differently: How to Reshape Your Firm and Regain Your Life.  In today’s episode, I talk you through those six-steps.

Here they are:

* Find your vision

* Deeply understand your clients

* Design amazing solutions

* Productise your services

* Embrace modern marketing

* Optimise your operations
