In this episode we will discuss what to do if you are involved in a transaction or litigation and the opposing party files for bankruptcy.

Episode 2 will focus on an overview of the types of business bankruptcies and why Subchapter 5 filings are taking center stage in the second half of 2021.

Episode 1 will be an interview with personal bankruptcy specialist, William R. Davis, Jr. (“Dickie”) and he will give us an overview of how and when to file for bankruptcy and the implications a bankruptcy will have on future.

In Episode 5, Clinton is joined by the man who is founder of Langley & Banack’s Karnes City Office and Clinton’s father, Richard Butler.  In this episode, Clinton and Richard will explore in depth the ever changing nature of the Executive Right (the right to enter into an oil and gas lease) and how that right has evolved over time.  The conversation will focus on a new Texas Supreme case that has drastically changed Executive Right law and which  Clinton and Richard were key players on.

In Episode 4, Clinton is joined by Stephen Ahl, a partner at Langley & Banack’s San Antonio and Carrizo Springs Offices and a member of Langley & Banack’s Oil, Gas, and Energy Practice Group and Allen DeBard, a partner at Langley & Banack’s San Antonio Office and member of Langley & Banack’s Bankruptcy Practice Group.  In this episode, Clinton, Allen and Stephen discuss the different types of bankruptcies, how oil and gas companies manage their way through these different types of bankruptcies, and how mineral owners can best protect their rights when their lessee goes bankruptcy. 

In Episode 3, Clinton is joined by Stephen Ahl, a partner at Langley & Banack’s San Antonio and Carrizo Springs Offices and a member of Langley & Banack’s Oil, Gas, and Energy Practice Group.  In this episode, Clinton and Stephen discuss the different types of transactions that a mineral owner can enter into with oil and gas companies and companies adjacent to the production of hydrocarbons.  The episode eventually turns into two former prosecutors swapping war stories about the different court room fights that they have gotten into with oil and gas companies on behalf of their mineral owner clients.

In Episode 2, Clinton is joined by Elizabeth Kopecki, a partner at Langley & Banack’s Karnes City Office and member of Langley & Banack’s Oil, Gas, and Energy Practice Group. In this episode Clinton and Elizabeth discuss how minerals can be conveyed and reserved through conveyance instruments such as deeds or assignments.  The episode then shifts into a discussion into the different types of title disputes that mineral owners can find themselves in.

In Episode 1, host Clinton Butler, the Chair of Langley & Banack’s Oil, Gas, and Energy Practice Group, takes us on a surface level tour of the different ends and outs of oil and gas law in Texas, specifically those particular rights and interests that collectively form a “Mineral Interest.”  Clinton is joined in this podcast by his wife, and non-lawyer, Patricia Butler.  Patricia serves as the audience’s avatar interjecting questions that any normal person might have regarding the topics covered by Clinton in this episode.
