In response to a wrongful death lawsuit, Disney attempted to argue that when the plaintiff signed up for Disney+, he had agreed to the terms and conditions that mandated that all claims go through arbitration before they are filed in court. Disney argued this included his claim of wrongful death at a restaurant in Disney Springs.


Disney have since withdrawn this defence and will argue the substantive elements of the wrongful death case in court without prior arbitration.
