New York State experienced six massive reforms to criminal justice since 2018. One we are familiar with is bail reform, which was implemented in the last quarter of 2019. Data for the nine years preceding bail reform and the four years post bail reform illustrates violent crime is still significantly high.
A major tenet of bail reform was the edict of Least Restrictive Means, directing that a judge will impose the least restrictive conditions necessary to ensure the defendant’s appearance in court. Though the term was removed by the Governor in the budget process, the culture and many of the major tenets of the law created by legislators exist.
