It is an old adage that words have weight and, once said, they cannot simply be undone. But what if these words are untrue, insulting, or damaging to a person’s character, reputation, or integrity? While the legal remedy of defamation certainly exists can it really undo the injustice suffered?
In this episode Christopher Murphy talks to Randall Stephenson about defamation in the context of the 2024 US Presidential Election. Together, they look at an election campaign that has been marked by its very personal nature. In discussing how the laws of defamation apply to politics, Randall not only provides insights into the past but also discusses the present and the future, with a particular focus on whether the United States’ defamation rules are fit for the contemporary political era.
